These Terms of Service ("Terms") govern your access to and use of The Card Investor (the "Service"), operated by Davin Harris as a sole proprietor ("we," "us," "our"). By creating an account, subscribing, or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Card Investor is a subscription-based informational service that publishes opinions, summaries, and analysis related to sports trading cards and trading card games (TCGs). The Service is for entertainment and informational purposes only. We are not a registered investment adviser, broker, or dealer. Nothing on the Service is financial, investment, legal, or tax advice. Card values are speculative and can decrease as well as increase. You are solely responsible for your purchasing and selling decisions.
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account. You agree to provide accurate information at signup, keep your password confidential, and notify us promptly at support@thecardinvestor.com if you believe your account has been compromised. You are responsible for all activity under your account.
The Service is offered as a paid subscription with monthly and yearly plans. New users may receive a free trial; the trial length is shown at sign-up. After the trial, your subscription will renew automatically at the then-current price for the plan you selected until you cancel. You may cancel at any time from your account or by emailing us — cancellation takes effect at the end of the current billing period.
Payments are processed by Stripe. The Card Investor is the merchant of record and is the party you are contracting with for the Service. Card details are collected and handled by Stripe under its own terms and PCI-compliant systems; we never receive or store full payment card numbers on our servers.
Refunds are governed by our Refund Policy.
We may suspend or terminate accounts that violate these rules, with or without notice.
If you submit testimonials, comments, or other content, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and adapt that content in connection with the Service. We may moderate or remove user-submitted content at our discretion.
All content on the Service — including text, picks, analysis, design, logos, and code — is owned by us or licensed to us and is protected by copyright and other laws. You receive a limited, personal, non-transferable license to access content while your subscription is active. No other rights are granted.
The Service links to third-party marketplaces (eBay, COMC, Whatnot, etc.) and other websites. We do not control and are not responsible for their content, prices, or practices. Some links may be affiliate links, which means we may earn a commission at no extra cost to you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any pick, projection, price, or analysis is accurate, complete, or will produce a particular result. Card prices are volatile; past performance does not guarantee future results.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or trading or investment losses arising from your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) US$50.
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
We may modify the Service or these Terms at any time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify subscribers by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to personal jurisdiction there. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and governing law) will survive.
